A 15-year-old Wichita girl who was sexually assaulted by a stranger while waiting for a school bus last month told police the man “physically picked her up and put her in the front seat” of his SUV after she refused his offer for sex, according to a probable cause affidavit released Thursday.
The girl told authorities that the man — alleged to be 31-year-old Gonzalo Ramirez Alba — “pulled up ... and asked her for sex” after she left her home to head to her bus stop around 5:45 a.m. on Sept. 15, the affidavit says.
“(The girl) said she told the male no, and the male exited the vehicle and approached her. (She) said she froze and could not move or scream,” according to the affidavit.
The man drove her down the street and backed into a driveway, then briefly got out of the SUV to turn off a light at the house there.
When he returned to the vehicle, he demanded she undress and perform sex acts, the affidavit says.
When she refused, he grabbed her, “crossed over the center console” and sexually assaulted her, according to the affidavit.
When he finished, he “told her to get dressed and walk home,” the affidavit says.
The girl disclosed the assault to her foster sister and foster mother, who called 911 around 6:40 a.m.
The girl’s description of the SUV and her attacker, as well as video from a home in the neighborhood, helped authorities track them down.
When police talked to Ramirez Alba, he initially said he had not left home all night then instead said he had gone to a nearby gas station between 4 and 5 a.m. to buy gummy bears, the affidavit says.
Ramirez Alba later told a woman during a jail phone call that “he had been drinking all night with a friend” and did “stuff” with a girl who had “asked him for a ride,” the affidavit says.
A lawyer listed in court records for Ramirez Alba did not immediately respond to a request for comment Thursday.
Wichita police have said the sexual assault happened in the 1500 block of South Kansas, near Harry and Hydraulic.
Ramirez Alba, of Wichita, is charged with aggravated kidnapping, aggravated criminal sodomy, indecent liberties with a child and indecent solicitation of a child. His next court date, a preliminary hearing, is scheduled for Nov. 3, court records show.
Ramirez Alba was released from the Sedgwick County Jail last month after posting a $500,000 bond. His bond conditions include a prohibition on contact with anyone younger than 18 and a requirement that his whereabouts be tracked with GPS monitoring equipment, court records show.
