Woman who shot, killed her boyfriend during argument told Wichita police he had a gun
A Wichita-area woman charged with murder in the shooting death of her boyfriend claimed her actions were self-defense during an argument.
Stacey Peters, 46, of Haysville, is charged in Sedgwick County District Court with second-degree murder in the deadly domestic violence shooting of Robert Duvaul, 41. Wichita police have said the couple was at a building she leases for her Ebay auction business in the 3000 block of South Hillside when officers were called early the morning of Nov. 19.
She remains held in the Sedgwick County Jail in lieu of a $125,000 bond.
An affidavit written by a WPD detective and released by the court on Thursday outlines the investigation into the case.
Peters was the one who called 911, the affidavit states — but not before she called at least one friend. Several people then went to the auction warehouse and convinced Peters to call 911.
Those witnesses, who apparently were not present at the time of the shooting, would later tell police that Peters and Duvaul were having a verbal fight that night that continued into the next morning. One witness said Peters told her that evening that “Bob is starting his crap again.” Another witness told police that after the shooting, Peters said Duvaul had accused her of sleeping with other people.
When Peters called 911 at around 2:33 a.m. — more than an hour after calling a friend — she told the Sedgwick County dispatcher that she “shot somebody that was intruding” when he came at her with a gun. When officers arrived, she told them that she had been arguing with Duvaul, that he had a gun, that he was threatening to damage her property and that he was threatening to kill her. She told police that she shot him.
Duvaul was found inside the building lying on his back. His body had a gunshot wound to the torso. He was pronounced dead at the scene.
The only gun mentioned in the affidavit is the firearm that was in a holster on Peters’ hip when officers arrived. The detective did not write in the affidavit whether or not any other guns were found at the scene.
