Ex-Sedgwick County Jail deputy accused of violating probation

A former Sedgwick County Jail deputy convicted of sex crimes against inmates is facing a probation violation hearing later this month after he was convicted in a DUI case in a neighboring county.

A warrant filed Friday in Sedgwick County District Court says David Kendall drove while intoxicated and refused breath testing on Jan. 3 in Sumner County. He pleaded guilty to both offenses on Aug. 14, prompting the probation violation allegations in the local sex crimes case, according to the warrant and Sumner County District Court records.

Kendall is due before Sedgwick County District Judge Joe Kisner on Sept. 25 for the probation violation hearing.

He is scheduled to be sentenced that same day in Sumner County District Court in the DUI case.

Among his probation terms in the sex crimes case, Kendall was ordered to not possess or consume alcohol or drugs without a prescription from a physician, Sedgwick County District Court records show.

Kendall, 25, was placed on probation for two years by a Sedgwick County District Court judge last June after pleading no contest to six counts of attempted unlawful sexual relations with inmates and one count of making a false information. The crimes involved six different inmates and occurred in April and June of 2012.

Originally he was charged with a dozen crimes, including felony aggravated criminal sodomy and misdemeanor sexual battery.

If Kendall is found guilty of the probation violation, the judge could leave him on probation, extend the length of his probation or impose a jail sanction. He also could send Kendall to prison for the underlying sentence in the sex crimes case, which is 26 months.
