A Sedgwick County Jail deputy bit his live-in girlfriend’s wrist when she reached for his cellphone during a fight on Halloween and waited in the back seat of her car to confront her after she moved out and told him to leave her alone, according to a probable cause affidavit that gives new details about the reasons for the deputy’s arrest.

Prosecutors charged Brandon Joseph Antoine, 20, of Wichita with misdemeanor domestic battery and misdemeanor stalking last month after the woman filed a police report on Nov. 4, but authorities released no specifics about what happened in the aftermath of his Nov. 6 arrest. A lawyer listed for Antoine in court records did not respond to a message seeking comment.

He is currently out of jail on bond while awaiting a bench trial.

The woman told law enforcement she and Antoine had argued on Oct. 31 “because he bought tacos for himself and a female coworker, but was being dishonest about it,” the affidavit says.

When she questioned Antoine about his coworker, he “became upset and told her to drop it,” the woman told law enforcement.

He was on his phone and “not paying attention to her” when she reached across him to “grab his phone,” she said.

Antoine “bit her on the right wrist” in response, the affidavit says.

The woman told authorities she left the apartment not long after Antoine bit her. He was sleeping on the couch when she returned.

The next morning he woke her up and asked for a ride to work. After she dropped Antoine off, she moved her property out of their apartment and sent him a message saying their relationship was over “and not to speak to her again,” according to the affidavit.

In subsequent days, Antoine messaged her and showed up at an event where he knew she’d be. He also waited for her in a parking garage, got into her vehicle and refused to get out for “a couple of minutes” after she told him to go away, the affidavit says.

The woman told authorities when she saw Antoine at the event, she altered her appearance, “hid in a corner” and retreated to a bathroom to avoid him because she felt upset and scared.

She said she “initially froze” when she noticed Antoine sitting in the rear passenger seat of her car when she went to leave the event.

When she told him to get out, he asked her why and accused her of mean, the affidavit says.

Antoine later told law enforcement he had reclined the car seat and “was laying in the back” of her vehicle waiting for her, the affidavit says. He told authorities he went to the event because he knew she would be there and “intentionally” searched for her car. He said he then went home, retrieved a traffic ticket she left behind when she moved out and went back to the parking garage to wait in her car, according to the affidavit.

He admitted that he didn’t have permission to be in her vehicle and knew she didn’t want to see or talk to him, the affidavit says. He also told authorities that “he tried not to put his hands on” her but “may have pushed her away” and “bit (her)... on the wrist when she was trying to get his phone” on Halloween.

The Sedgwick County Sheriff’s Office last month said Antoine had been “suspended from duty, pending the resolution of both the criminal case and an internal investigation.” He started working for the Sheriff’s Office in July.

Antoine made a first appearance in Sedgwick County District Court on the stalking and domestic battery charges on Nov. 12, court records show. He has a bench trial scheduled for Jan. 6.
