South Wichita used car dealer admits to violations, will refund customer and pay fine

A used car dealership in south Wichita admitted to violating the Kansas Consumer Protection Act and agreed to pay more than $22,000 in penalties and a refund to a customer, the Sedgwick County District Attorney’s Office said Friday.

The Attorney’s Office said it reached an agreement with Rafmen LLC at 3020 S. Old Lawrence. The District Attorney’s Consumer Protection Division started investigating the dealership after a customer complained that it didn’t disclose damage and possible safety issues on a car they purchased.

The division inquired from “several other mechanics, reviewed safety recall information, licensing, and advertisements” and determined the dealership violated the act. Specifically, the Attorney’s Office said:

  • The dealership failed to disclose safety issues
  • Salesperson Abiodun Subair was unlicensed
  • They advertised vehicles on Facebook Marketplace but didn’t say the sales were being offered by a dealership

Owners Wasihi Subair and Abiodun Afodunrinbi and salesperson Subair admitted to the violations and agreed to refund the consumer $2,621, the DA’s Office said. The agreement also calls for the dealership to pay “$20,000 in civil penalties in addition to other costs and expenses.”

“The consent judgment also calls for an injunction from engaging in deceptive or unconscionable acts and cooperation with any future complaints,” the Attorney’s Office said in a news release.

The Attorney’s Office said recalls can be checked before purchasing at safercar.gov/vin. Recalls and repairs are free and covered by the manufacturer, the Attorney’s Office said.
