After taking cupcakes at Dillons, he fought an officer trying to stop him, police say

A man who walked out of a Dillons in south Wichita with cupcakes that cost $2 fought the officer who tried to stop him, police said.

An officer was at the Dillons at 47th South and Broadway at around 2 p.m. Sunday to look at security video for an investigation into an unrelated case when store employees told the officer a man was shoplifting, Officer Paul Cruz said.

The 23-year-old man walked out of the store, Cruz said, and a police report lists $2 cupcakes as the only loss.

The officer approached the man and attempted to arrest him, but the man fought the officer, Cruz said. The man tried to get the officer's holstered gun and tried to hit him with large rocks, Cruz said.

Store employees and other bystanders helped subdue the man, Cruz said.

The officer, who had a minor hand injury, never lost control of his gun, Cruz said.

Booking reports show Victor Allan Posch, 23, of Andover was arrested on suspicion of aggravated robbery, battery, aggravated battery of a law enforcement officer, interference with a law enforcement officer and possession of drug paraphernalia in connection to the case.

He remains in the Sedgwick County Jail.
