Kansas contractor to pay more than $50,000 in deceptive-practice case

A Haysville contractor and his company have entered into a consent judgment with the Sedgwick County district attorney in a case involving allegations of deceptive practices against four consumers, three of whom were elderly.

Bradley Rodgers, the owner of Rogers Contracting LLC, will pay $52,577 in fines, court costs and investigative fees.

Rogers is accused of failing to provide consumers with a “three day right to cancel” notice. When one consumer opted not to hire the company after a free estimate, Rogers threatened to sue her. One homeowner’s contract price was increased without the homeowner’s consent, and when he didn’t agree to the change, Rogers threatened to sue him. The third complaint was of similar nature, the District Attorney’s Office said.

The Kansas Consumer Protection Act requires businesses that offer services outside their place of business to provide customers with the right to cancel orally and in writing. The KCPA also protects consumers from excessively one-sided transactions, falsehoods and misleading statements.

The agreement includes a 36-month probationary period, subject to monitoring by the District Attorney’s Office. Rogers entered the consent judgment with the District Attorney’s Office without admitting to the allegations.
