Man sentenced to 38 months for role in Arkansas man’s death

A 21-year-old Wichita man will spend 38 months in prison for his role in the killing of an Arkansas man during a robbery at a rental house in November 2013.

Attorneys involved in the case agreed Thursday that Orville T. Smith should receive the sentence for involuntary manslaughter and other convictions because he played a minimal part in the shooting of 27-year-old Paul Danny Khmabounheuang, and because he agreed to testify against three other men charged in the case.

“He was not an original planner (in the robbery) like Corey Pollard and Dallas Guy were,” Sedgwick County Assistant District Attorney Jennifer Amyx said at his sentencing hearing, naming two of Smith’s co-defendants. The third is Dijon Thomas.

“He got drug in about an hour before to drive” to the house at 1452 N. Holyoke, where Khmabounheuang died during a shootout on Nov. 13, 2013, she said.

Defense attorney Chrystal Krier said Smith, who pleaded guilty to the charges, was the only one of the four men who wasn’t armed. She also said his testimony led to Pollard’s first-degree murder conviction and Guy’s guilty plea. District Judge Jeffrey Goering imposed Smith’s sentence.

Guy was sentenced Wednesday to 178 months in prison on involuntary manslaughter and other charges, according to court records. Pollard, who was convicted of first-degree felony murder, is serving a life prison sentence. Thomas is serving a 38-month sentence.
