7-year-old survivor of sexual assault ID’d suspect, affidavit says
The 7-year-old victim in an attempted murder and sexual assault in Wichita last month was immediately able to point out a suspect in a police photo line-up, according to an affidavit released Thursday.
“That’s him,” the girl told police on June 16, five days after the attack. “He did it to me.”
Corbin Breitenbach, 23, is accused of strangling and raping the girl at a west Wichita condo on June 11.
Breitenbach – who went to prison after being convicted of strangling and sexually assaulting a 22-year-old woman in 2012 – has been charged with attempted capital murder, aggravated criminal sodomy and aggravated burglary.
If convicted on his latest charges – attempted capital murder, aggravated criminal sodomy and aggravated burglary – he would face life in prison. Breitenbach, who was on parole, was released from prison six weeks before the attack.
According to the affidavit released by the Sedgwick County District Court, the victim and her brother were staying overnight at the apartment of a woman who is a friend of the victim’s mother on morning of the attack.
The woman, the affidavit said, was awakened at about 2:30 a.m. by the sound of the victim crying.
On June 15, the affidavit said, a DNA sample found on the victim was verified as belonging to Breitenbach.
Testing at the Sedgwick County Regional Forensic Science Center, the affidavit said, revealed that the chance of the DNA sample not being of the same profile as a sample taken from Breitenbach in 2012 would be about one in 107 octillion.
On the night of the attack, the affidavit said, it was determined that Breitenbach was staying in his girlfriend’s apartment, which was in a building adjacent to the building where the victim was visiting. The girlfriend’s apartment, the affidavit said, is of the same internal configuration of the apartment where the victim was staying.
Breitenbach’s girlfriend told investigators she went to a bar to pick him up shortly after 1 a.m. the morning of the attack. Once they returned to her apartment, she said, he mentioned that he needed to “burn off alcohol.”
Breitenbach left, she said, returned to the apartment and was in bed by around 2:30 a.m. She said he “almost immediately” fell asleep. His next court appearance is scheduled to be a preliminary hearing on Aug. 23, according to a spokesman for Sedgwick County District Attorney Marc Bennett.
