Spirit AeroSystems has filed a lawsuit against one of its suppliers.
Spirit claims in the suit filed in federal district court that Kuka Systems Corp. North America failed to deliver a manufacturing robot by the agreed-upon deadline.
The company ordered the 787 Automated Skin Fastening Cell in 2007. The equipment was to be completed by Sept. 4 and delivered by Oct. 28.
According to the suit, Kuka told Spirit that it would not spend any more time or money on building the robot system without a modification of the contract.
Spirit says in the suit that it will terminate the contract 10 days after giving notice on Nov. 20.
Spirit is suing for damages in excess of $75,000.
A spokesman for Spirit could not be reached Friday. Messages left at Kuka were not returned.
Kuka Systems Corp. North America is a major supplier of assembly and welding systems for the automotive, aerospace, alternative energy and manufacturing industries.
It is an arm of Kuka Systems Group, based in Augsburg, Germany, which has more than 3,500 employees in 15 countries.
