WICHITA -- A Sedgwick County district judge has scheduled a hearing this afternoon to rule on a motion to suppress evidence by a man charged in a double murder on Thanksgiving 2009.
Sam Holton’s lawyer, Sal Intagliata, last week asked Judge David Kaufman to exclude evidence, including the 18-year-old’s confession, because of an illegal search by Wichita police at Holton’s home in Mulvane.
Prosecutor Marc Bennett has said police acted properly, and that Holton’s mother invited detectives into her house after she found her son with jewelry taken from the home of Adrian Jackson and Jessie Foust, who were found dead on Thanksgiving Day last year.
Kaufman has set a hearing for 3:30 p.m.
