WICHITA — A Wichita man has been acquitted of a felony animal cruelty charge that was filed after police said he struck a dog with a baseball bat.
Prosecutors said a jury returned a not guilty verdict late Thursday against James Jarvais, 27, in Sedgwick County District Court.
Efforts to contact Jarvais' public defender Friday were unsuccessful.
During Jarvais' trail, an 8-year-old boy told the jury that he saw a neighbor strike a Chihuahua mix named Popeye with a baseball bat on Oct. 6, 2009. The dog was later euthanized.
Although the boy couldn't identify Jarvais in the courtroom, another witness identified Jarvais as the one who struck the dog.
