EMPORIA, Kan. | An Emporia woman accused of abandoning her newborn baby in a trash bin has been bound over for trial.
Radio station KVOE reports that a judge ruled Thursday there was enough evidence to try Christina Nicole Devine on a charge of attempted first-degree murder.
A maintenance worker found the 7-pound, 10-ounce baby boy alive in October. He was wrapped in a trash bag in the trash bin in Emporia.
Devine reportedly went to work the same day she gave birth. Police received a tip from a coworker who said she looked pregnant one day but not the next.
A pediatrician testified during the preliminary hearing that the newborn's body temperature was much lower than normal when he was found. The doctor said the boy also had shallow breathing, a respiratory problem and an infection.
