Felony charges dismissed in attempted Newton abduction that wasn't

Felony charges were dismissed today against two Newton men who were charged last week with attempting to abduct an 11-year-old girl outside her home.

Harvey County Attorney David Yoder said the charges arose from a misunderstanding that occurred when one of the men stopped to visit his parents, who had recently moved into the girl's neighborhood.

Compounding the misunderstanding, Yoder said, was a brief quarrel that occurred between the men over parking. When one of the men yelled at the other to "get in the car," Yoder said, the girl mistakenly thought the order was directed at her.

Both men — Kenneth Rodriguez, 27, and Matthew Regier, 20 — were charged with attempted kidnapping, aggravated indecent solicitation of a child and transporting an open container of alcohol. Regier also was charged with being a minor in possession of alcohol.

Rodriguez was released from the Harvey County Jail late Tuesday after felony charges against him were dismissed. Regier remains in custody on unrelated armed robbery charges.
