Kansas man found not guilty of exposing teen to HIV

HUTCHINSON, Kan. | A 43-year-old Hutchinson man with HIV has been found not guilty of knowingly exposing a male teenager to the virus by having sex with him.

A Reno County jury on Wednesday acquitted Harlin Bailey after two hours of deliberations. He faced a felony count of exposing another to a life-threatening communicable disease for performing oral sex on the teen in 2007.

Defense attorney Kelly Driscoll told jurors that Bailey took what he believed were reasonable precautions, including warning him beforehand that he had HIV and not allowing the teen to perform oral sex on him.

District Attorney Keith Schroeder questioned whether Bailey actually discussed his disease with the teen. He also expressed doubt the teen -- a special education student at the time -- was capable of understanding.
