GREAT BEND — Prosecutors are seeking to amend charges against the man accused of killing a 14-year-old Great Bend girl whose burned body was found at an asphalt plant.
Adam Joseph Longoria was initially charged in Barton County District Court with capital murder, criminal sodomy, vehicle burglary and theft in connection with the August 2010 death of Alicia DeBolt.
The state now wants to add the qualifier of attempted rape to the capital murder charge. Prosecutors also want to amend the other charges to indecent solicitation of a child, vehicle burglary and theft.
Defense attorneys say that violates Longoria's rights because the new information charges him with two different crimes than he is currently facing. They are demanding a new preliminary hearing if the court allows the amendments.
A hearing over numerous motions, mostly concerning evidence issues, is set for Thursday in Barton County.
