Magellan Pipeline Co. of Tulsa has agreed to pay a $46,200 penalty to settle federal Clean Water Act violations related to a failed test of its emergency response at its Valley Center oil terminal as well as a March oil spill in Iowa.
Magellan has certified under terms of the settlement that it has taken steps to fix the problems.
EPA staff conducted a surprise inspection of Magellan's bulk oil storage facility at 1120 S. Meridian in Valley Center in May 2009. Magellan staff were unable to effectively deploy a containment boom within an hour, as required by federal regulations.
Also, on March 14, Magellan reported a spill of 5,000 gallons of diesel oil from its pipeline near Milford, Iowa into a nearby unnamed creek.
