State closes Olathe day care center where infant died last year

More than a year after an infant died at Precious Little Angels Day Care in Olathe, state officials have shut down the home-based center for failing to comply with licensing regulations.

A 10-month-old child died in January 2013 after being left sleeping in a car seat at the day care at 1162 E. 126th St. At that time, the Kansas Department of Health and Environment told Precious Little Angels that the department intended to suspend the day care’s license, said Aimee Rosenow, a department spokeswoman.

Precious Little Angels, which had been licensed since 2011, was allowed to continue operating while a series of state inspections was conducted.

In an inspection in February 2013, the day care provider was warned about following rules for where children could nap. According to inspection reports, a child was found sleeping on a couch and was moved to an appropriate spot — a crib mattress on the floor.

Compliance officers also reported that a fence surrounding a pool had a large gap that could allow access for young children. The inspection noted other violations, including a hinge gate left open at the top of stairs and an uncovered electrical outlet in a bathroom used by children.

In an inspection Friday, a child was found napping on an adult bed and the pool gate was open. Seven children were in the center’s care at the time.

An emergency license suspension was issued, and the facility was closed. Maricela Rodriquez, the owner, did not answer calls Monday.

Rosenow said Rodriquez has 15 days to appeal the state’s action and the right to a hearing.
