Appeals court Judge Joseph Ellis has denied a petition from 3rd district candidate Michael Fletcher to immediately overturn his disqualification as a Kansas City Council candidate.
In a 3-paragraph order Ellis denied Fletcher’s appeal.
It isn’t immediately clear what Fletcher’s next legal step might be. He has further appeals, but none is likely to succeed before tomorrow’s election.
Fletcher remains on the ballot, and says he’ll continue his campaign and legal battle.
“We’re going to go win this election,” Fletcher said Monday morning. “For a circuit court judge to say she could disqualify thousands of votes is outrageous.”
Clinton Adams, an attorney for incumbent Sharon Sanders Brooks said they will answer any further legal challenge.
“We’re prepared to respond to any legal step or action he takes,” Adams said.
Representatives of both sides say the appeals court has rejected Michael Fletcher’s appeal, and he remains disqualified for Tuesday’s election.
He’ll still be on the ballot, but if he wins his spot will be declared vacant — absent an overturn by the full court or the Missouri Supreme Court.
