A Sedgwick County district judge is scheduled to hear arguments today from Wichita businesses who want to block a state smoking ban.
Judge Jeff Goering is set to hear arguments at 2 p.m. on whether to extend a temporary restraining order that prevents the state law from being enforced in Wichita.
Lawyer Harry Najim filed two motions in the last week asking to add more businesses to the lawsuit.
Another judge, Eric Yost, issued the restraining order June 18 on behalf of three Wichita businesses: Mort's Cigar Bar, Walt's Sports Bar and Phoenician Room and Heat Cigar Bar & Hookah Lounge.
Never miss a local story.
The statewide smoking ban went into effect July 1. It bans indoor smoking in restaurants, bars, workplaces and other public areas. But it contains exemptions, including for tobacco shops and the gaming floors of state-owned casinos.
Najim has argued that Wichita's city ordinance banning smoking is more restrictive than the state law.
