Surviving Oteros file against Rader

The surviving family of BTK's first victims have joined the growing list of those filing civil lawsuits against Dennis Rader.

Lawyers in Tempe, Ariz., and Wichita representing three members of the Otero family filed suit Friday in Sedgwick County District Court.

Daniel Otero, Charlie Otero and their sister, Carmen Montoya, were in school Jan. 14, 1974, when Rader entered their house in Wichita and killed their parents, Joseph and Julie, along with their brother Joseph II and sister Josephine.

To keep him from profiting from his story, the suit is seeking unspecified monetary damages against Rader for the pain and suffering he caused. The Oteros "lived in fear that the murderer was intent upon murdering the entire family," the petition reads, "and so feared he would find and kill them, which caused them further, ongoing severe emotional trauma."

Last month Rader, 60, pleaded guilty to killing 10 people. He is set for sentencing on Aug. 17. He faces life in prison.
