Ken Thomas, who operates pet-food maker Treatco, 2302 N. Broadway, filed a civil lawsuit on Monday against the city of Wichita and three emergency personnel in connection with his arrest during a 2011 fire at the plant.
Thomas alleges in the suit that while the fire was under way he tried to direct firemen to turn off the electricity to the plant, but was ignored. When he persisted, he was violently arrested, he claims.
He is accusing the city of Wichita, Wichita police officer Colin Gallagher, and Wichita Fire Department investigators Chris Dugan and Joseph Evans of excessive force, false arrest, malicious use of force, negligent use of force, battery and causing emotional distress. He is seeking in excess of $75,000.
City Attorney Gary Rebenstorf said Wednesday that he couldn’t comment until he had seen the suit.
