A Butler County judge has dismissed a murder charge against one of two suspects in the child-abuse homicide of 18-month-old Jayla Haag of El Dorado.
District Judge David Ricke dismissed the case against Justin Edwards, 29, after Edwards’ court-appointed lawyer told the judge that he was still awaiting the autopsy report in the case as he was preparing to go to trial in October. A first-degree murder charge is still pending against the child’s mother, Alyssa Haag, 23.
David Moses of Wichita, who is representing Edwards, said Friday that testimony at an earlier hearing showed that doctors at the Sedgwick County Regional Forensic Science Center had yet to complete all the testing needed to complete the autopsy report. Because Ricke dismissed the case without prejudice, Moses said, the charge against Edwards can be refiled once the autopsy report is complete.
