Wichita police identify man shot, killed in Old Town on Saturday

Wichita police identified the man who was shot to death on Saturday morning in Old Town as Marquez Smart, 23.

The Kansas Bureau of Investigation is collecting information on the case and will present its findings to the Sedgwick County district attorney to determine whether charges should be filed, Police Chief Norman Williams said Monday.

Police had said the shooting started after a concert ended at Doc Howard’s Lounge; club-goers were moving through the streets. The Doc Howard’s owner said over the weekend that the concert ended 15 minutes before the shooting, and questioned why police linked the shooting to his club, given that the shooting started a block south and a block west of his club.

Williams described what police say happened along the 200 block of North Mosley in Old Town between 1:45 and 1:50 a.m. Saturday.

He said Smart was moving along with a crowd going south on Mosley when he pulled a gun, a semi-automatic handgun, and fired at least two shots. He then ran north, on the sidewalk alongside the Old Town parking garage, right toward officers who happened to be standing there.

Williams said officers there included on-duty and off-duty officers. The officers chased the man, fired several shots when he refused their orders to drop his gun, then chased him into an alley, where they again fired, this time fatally wounding him, Williams said.

The man disobeyed orders repeatedly from the officers to drop the gun, Williams said. He was hit multiple times; Williams declined to say how many times.

Four other people were wounded; forensics has not yet determined whether they were hit by bullets fired by Smart, or whether bullets fired by police might have hit some of them.

Police did not give names for the wounded, but gave these descriptions: a 29-year-old man, hit in the right calf; an 18-year-old woman, hit in the lower right side; a 17-year-old woman, hit in the right calf; and a 19-year-old woman, hit in the right shoulder.

“It is unfortunate that they were hit because of the actions of this individual,” Williams said.

One officer involved in the shooting has one year on the force; the other has seven, he said.

Smart was taken to Via Christi Hospital on St. Francis, where he was pronounced dead at 2:32 a.m. Saturday, Williams said.

Police routinely station officers in the Old Town area to deal with disturbances and help people if needed, he said.
