Prosecutors schedule retrial of Matthew Noel in crash that killed 5-year-old girl

— Matthew Noel will face trial again in February after a jury failed to reach a verdict on charges against him.

A new trial has been set for Feb. 12 in Sedgwick County District Court – a year to the day after the crash on west Kellogg that killed 5-year-old Amber Randolph and injured her mother, Michelle.

Jurors last week could not decide if Noel committed a crime in the crash. Noel had been charged with involuntary manslaughter in Amber’s death and aggravated battery for Michelle Randolph’s injuries.

Noel’s truck crashed head-on into the Randolphs’ car at about 3:45 p.m. last Feb. 12, after he sailed over a concrete median near Kellogg and Seneca and skidded over the eastbound lanes to hit Randolph’s car as it sat on the shoulder. She testified during the trial that she’d pulled over to try and avoid a collision when she saw the truck coming over the barrier.

Prosecutors say Noel had been racing with his friend Ron Bevan as they headed west on Kellogg that afternoon. Noel contended he was cut off by Bevan, who caused the accident.

Jurors said they couldn’t decide whether Noel had acted recklessly in causing the crash.

Bevan, who is charged with second-degree murder, is set for trial next month.
