A Pratt County man is suing the Wichita Police Department, saying officers kicked and used a Taser on him in a forgery case.
Justin Roberts filed a lawsuit last week in Sedgwick County District Court against the city of Wichita, the police department and the chief of police.
John Sullivan, Roberts' lawyer, said in the filing that they told the city of their claims last July but could not reach a settlement before going to court.
Sullivan filed suit Nov. 23. The city has 20 days from that date to respond. The city of Wichita does not comment on pending litigation.
In the lawsuit, Sullivan said that Roberts was arrested on July 31, 2008, following the report of bad checks written at a QuikTrip store.
Officers saw a car they thought was involved. Roberts left the car and ran away, the lawsuit said.
Among the claims, Sullivan said, were that after officers found Roberts hiding under an inflatable children's pool, they began kicking him and using a Taser on him.
The lawsuit said that despite Roberts' request for medical treatment, he received none until after he was booked into the Sedgwick County Jail. Roberts then was treated for broken ribs and other injuries at a Wichita hospital, the suit said.
Court records show Roberts pleaded guilty to possession of drugs and forgery in the fall of 2008 and was sentenced to one year of probation.
